Welcome to imgland ("the Service", "we", "us", "our"). By accessing or using imgland, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not use the Service.
imgland is an image hosting service that allows anonymous uploading and sharing of images. The Service is operated from and governed by the laws of England and Wales, United Kingdom.
1. Eligibility
You must be at least 18 years of age or the age of majority in your jurisdiction to use the Service. By using imgland, you represent and warrant that you meet this requirement.
2. The Service
imgland provides anonymous image hosting. You may upload images without creating an account. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.
We do not guarantee the availability, permanence, or integrity of any uploaded content. Images may be removed at any time for any reason, including but not limited to violation of these Terms.
3. Prohibited Content
You must not upload, share, or distribute any of the following content through the Service. Violation will result in immediate removal of content and may be reported to law enforcement where required by law.
3.1 Illegal Content (UK Law)
In compliance with the UK Online Safety Act 2023 and other applicable UK legislation, the following content is strictly prohibited:
- Child sexual exploitation and abuse material (CSAM/CSEA) — Any imagery depicting the sexual exploitation or abuse of children. This includes AI-generated or digitally manipulated imagery. All suspected instances will be reported to the National Crime Agency (NCA) and the Internet Watch Foundation (IWF). Zero tolerance.
- Terrorism content — Material that promotes, encourages, or glorifies terrorism or terrorist organisations as defined under the Terrorism Act 2000 and Terrorism Act 2006.
- Intimate image abuse — Non-consensual sharing of intimate or sexual images (sometimes called "revenge porn"), prohibited under Section 33 of the Criminal Justice and Courts Act 2015.
- Extreme pornography — Content falling within the definition of "extreme pornographic images" under Section 63 of the Criminal Justice and Immigration Act 2008.
- Hate content — Images that incite hatred on grounds of race, religion, sexual orientation, disability, or transgender identity under the Public Order Act 1986.
- Harassment, stalking, threats, and abuse — Content used to harass, stalk, threaten, or abuse any person, including content constituting controlling or coercive behaviour.
- Content promoting self-harm or suicide — Imagery that encourages or assists suicide or serious self-harm.
- Animal cruelty — Imagery depicting acts of cruelty to animals prohibited under the Animal Welfare Act 2006.
- Content relating to drugs, weapons, human trafficking, fraud, or other criminal activity — Including but not limited to the sale or promotion of controlled substances, firearms, knives, or other weapons, or facilitating any criminal offence.
3.2 Nudity and Sexual Content
imgland does not permit nudity or sexually explicit content of any kind. This includes but is not limited to:
- Full or partial nudity
- Sexually explicit or suggestive imagery
- Pornographic material of any type
- AI-generated sexual or nude imagery
3.3 Other Prohibited Content
- Content that infringes the intellectual property rights of any third party (see Section 5 — Copyright)
- Malware, viruses, or any file designed to disrupt, damage, or limit the functionality of any software or hardware
- Spam, phishing material, or deceptive content
- Content that impersonates any person or entity, or misrepresents your affiliation with any person or entity
- Personal or private information of another person without their consent (doxxing)
- Any content that is otherwise unlawful under the laws of England and Wales or the jurisdiction from which it is uploaded
4. Your Responsibilities
By uploading content to imgland, you represent and warrant that:
- You own the content or have the necessary rights, licences, and permissions to upload and share it
- The content does not violate these Terms, any applicable law, or the rights of any third party
- You accept sole responsibility for the content you upload and any consequences thereof
Although uploads are anonymous, we log certain metadata (see our Privacy Policy) and will cooperate with law enforcement agencies investigating illegal activity conducted through the Service.
5. Copyright and Intellectual Property
5.1 DMCA Takedown Notices
We respect the intellectual property rights of others. If you believe that content hosted on imgland infringes your copyright under the US Digital Millennium Copyright Act (DMCA), you may submit a takedown notice to our designated agent containing:
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing, with sufficient information to locate the material (e.g., the image URL)
- Your contact information (name, address, telephone number, email)
- A statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorised to act on their behalf
- Your physical or electronic signature
5.2 UK Copyright (CDPA 1988)
For copyright complaints under the Copyright, Designs and Patents Act 1988 (UK), we operate a notice and takedown procedure. Upon receiving a valid notification of alleged infringement and gaining actual knowledge of the infringing material, we will act expeditiously to remove or disable access to the content in question.
Copyright notices should be submitted through our report form, which lets you identify the specific images concerned.
5.3 Counter-Notifications
If you believe content you uploaded was removed in error, you may submit a counter-notification. We will process counter-notifications in accordance with the DMCA and applicable UK law.
5.4 Repeat Infringer Policy
We maintain a policy of terminating access for repeat infringers in appropriate circumstances.
6. Content Moderation and Reporting
In accordance with the UK Online Safety Act 2023, we maintain systems and processes to:
- Assess the risk of illegal content appearing on the Service
- Remove illegal content swiftly once identified or reported
- Prevent users from encountering illegal content where proportionate to do so
- Provide clear and accessible mechanisms for users to report content
You may report content via the report form available on every image page. We aim to review all reports promptly and will take appropriate action, which may include removing content and cooperating with law enforcement.
7. Licence to Uploaded Content
By uploading content to imgland, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, display, reproduce, and distribute the content solely for the purpose of operating and providing the Service. This licence terminates when the content is deleted from the Service, subject to reasonable backup and caching timeframes.
You retain all ownership rights in your content. We do not claim ownership of any content you upload.
8. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, secure, or error-free, nor do we warrant the accuracy, reliability, or completeness of any content hosted on the Service.
9. Limitation of Liability
To the fullest extent permitted by law, imgland and its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the Service.
Our total aggregate liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you have paid to us (if any) in the twelve (12) months preceding the claim.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
10. Indemnification
You agree to indemnify, defend, and hold harmless imgland and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand our practices regarding your data.
12. Termination and Suspension
We reserve the right to remove any content and restrict or terminate access to the Service at our sole discretion, without prior notice, for any reason, including but not limited to violation of these Terms.
13. Paid Subscriptions
Parts of the Service are offered as a paid subscription ("Pro"). Subscriptions are billed in advance on the interval you select (monthly or annual) and renew automatically for successive periods at the then-current price until cancelled. By subscribing, you authorise us and our payment processor to charge your payment method on a recurring basis.
Payments are processed by Stripe. We do not store your full payment card details. You are responsible for keeping your payment details accurate and up to date.
Prices are stated in US dollars and, unless expressly stated otherwise, are exclusive of any applicable sales tax, VAT, GST or similar charges, which may be added at checkout or which you may be responsible for paying.
We may change our prices, plans, features, usage limits, storage and retention allowances, and any other aspect of a paid plan at any time and at our sole discretion. Where a change increases the price of your subscription, it will take effect at the start of your next billing period. Your continued use of the Service, or the renewal of your subscription, after a change takes effect constitutes acceptance of it. If you do not agree to a change, your remedy is to cancel before your next renewal.
If a payment fails, we may retry the payment, and may suspend, downgrade or restrict access to paid features until payment is received. We may also withdraw or discontinue any plan or feature at any time.
14. Cancellation, Refunds and Retention
You may cancel your subscription at any time from your account billing settings. Cancellation stops future renewals; your subscription then continues until the end of the billing period you have already paid for, after which your account reverts to the free plan.
Except where required by law, payments are non-refundable and we do not provide partial, pro-rata or unused-period refunds — including where you cancel part-way through a billing period, do not use the Service, or where we suspend or terminate your account for breach of these Terms. Any refund we do provide is at our sole discretion and does not create an obligation to provide further refunds.
Where you are a consumer with a statutory right to cancel a distance contract, you expressly request that the Service begins immediately on purchase and acknowledge that you will lose that cancellation right once the Service has been fully performed.
We may change how long content is retained, and the limits that apply to free and paid accounts, at any time. Content may expire or be removed in accordance with the retention settings applicable to your account and plan at the relevant time. If your account reverts to the free plan, features and allowances available only on a paid plan will no longer apply, and you may be unable to upload further content until your usage falls within the free plan's limits. You are responsible for keeping your own copies of anything you upload; the Service is not a backup service.
15. Changes to These Terms
We may revise these Terms at any time by updating this page. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
If you are a consumer resident in the UK or EU, nothing in these Terms affects your statutory consumer rights under mandatory applicable law.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
